1. About Acanex

Acanex Online is an online education platform operated by Academic Nexus (Acanex) in Bamenda, Cameroon.

Acanex provides online courses, lessons, quizzes, assignments, examinations, certificates and other educational services. Courses may include content aligned with the Cameroon General Certificate of Education Ordinary Level and Advanced Level standards, as well as professional, vocational and other educational courses.

In these Terms:

• “Acanex,” “we,” “us” or “our” means Academic Nexus (Acanex).
• “Platform” means the Acanex website, courses and related online services.
• “User” means any visitor, learner, instructor, parent, guardian or other person using the platform.
• “Learner” or “student” means a person registered to access courses.
• “Instructor” means a person authorised to teach or publish courses through Acanex.
• “Course” means educational content or services offered through the platform.

2. Acceptance of These Terms

These Terms and Conditions form an agreement between the user and Academic Nexus (Acanex).

By registering an account, enrolling in a course, purchasing a course, teaching through Acanex or otherwise using the platform, the user confirms that they:

• Have read and understood these Terms;
• Agree to comply with these Terms;
• Have reviewed the Acanex Privacy Policy; and
• Have the legal capacity or required parental or guardian permission to use the platform.

If a person does not agree with these Terms, they should not register, purchase a course or continue using Acanex.

Parents, guardians or institutions creating or approving accounts for minors agree to these Terms on behalf of those learners where legally permitted.

3. Eligibility and Age Requirements

The minimum age for independently registering as a learner on Acanex is 14 years.

By independently creating an account, a user confirms that they are at least 14 years old.

Users between 14 and 17 years old remain minors. Where required by applicable law, they must use Acanex with the knowledge and consent of a parent or legal guardian.

Users under 14 may not independently create an account. An account for a learner under 14 must be created or appropriately authorised by a parent, legal guardian or authorised educational institution where permitted by law.

Acanex may request reasonable evidence of:

• A user’s identity or age;
• Parental or guardian consent;
• A parent’s or guardian’s identity and authority; or
• A person’s authority to represent an institution.

Acanex may restrict or suspend an account while this information is being verified.

4. User Accounts

Users must provide accurate and current information when registering. Registration information may include:

• First name;
• Last name;
• Username;
• Email address; and
• Password.

Users are responsible for:

• Keeping account information accurate;
• Creating a strong password;
• Keeping login details confidential;
• Preventing unauthorised access to their accounts;
• Logging out when using shared devices; and
• Reporting suspected unauthorised access promptly.

Each account is personal to the registered user. Unless expressly authorised by Acanex, users may not:

• Share an account;
• Sell or transfer an account;
• Allow another person to complete a course or assessment through their account;
• Create an account using false information;
• Impersonate another person; or
• Use another person’s login details.

Activities performed through an account may be treated as activities of the registered account holder unless Acanex receives reliable evidence of unauthorised use.

Acanex administrators and instructors will never need to know a user’s password or Mobile Money PIN.

5. Learner Accounts

A learner account gives the user access to the courses and platform features for which they are eligible or have paid.

Learners must:

• Use the platform for legitimate educational purposes;
• Complete their own assignments and assessments;
• Treat instructors and other learners respectfully;
• Follow course instructions;
• Respect copyright and confidentiality; and
• Comply with these Terms and other published Acanex rules.

Registration does not automatically give access to every course. Some courses may require payment, approval, prerequisites or separate enrolment.

6. Instructor Accounts

Registering as an instructor does not automatically guarantee approval to teach or publish courses on Acanex.

Acanex may review an instructor’s:

• Identity;
• Qualifications;
• Teaching experience;
• Professional biography;
• Profile photograph;
• Course proposal;
• Course materials; and
• Compliance with Acanex standards.

Instructors must ensure that all submitted information is accurate and not misleading.

Instructors may voluntarily provide professional photographs to help learners identify them and build trust. Instructor names, photographs, biographies, qualifications and course information may be publicly displayed on Acanex.

Instructors must only upload photographs and materials they own or are authorised to use.

Acanex may refuse, edit, unpublish or remove an instructor profile or course that:

• Contains inaccurate or misleading information;
• Does not meet Acanex’s educational or quality standards;
• Infringes intellectual-property rights;
• Contains unlawful or inappropriate material;
• Creates a safety or reputational risk; or
• Violates these Terms or an Instructor Agreement.

Additional instructor obligations, earnings and payment arrangements may be contained in a separate Instructor Agreement.

7. Courses and Educational Services

Acanex aims to provide accurate, useful and high-quality educational content.

Each course may have its own:

• Description;
• Instructor;
• Curriculum;
• Price;
• Access period;
• Schedule;
• Assessment requirements;
• Certificate conditions; and
• Technical requirements.

Users should review the course information before enrolling or paying.

Acanex may make reasonable changes to:

• Course content;
• Lessons and learning materials;
• Instructors;
• Course schedules;
• Assessments;
• Platform features; or
• Technical delivery methods.

Material changes affecting a paid learner will be communicated where reasonably possible.

If an instructor becomes unavailable, Acanex may appoint another suitable instructor, reschedule affected activities, provide alternative materials or take another reasonable measure.

8. Course Access Period

Access to a purchased course is provided for the period stated on the course sales page at the time of purchase.

Unless a different period is clearly stated in the course information, access will be available for a maximum of one year from the date of successful payment and enrolment.

Course access is personal and may not be transferred or shared.

Learners are responsible for completing the course within the stated period. When the access period ends, a learner may lose access to:

• Lessons;
• Videos;
• Downloadable materials;
• Assignments;
• Assessments;
• Instructor support; and
• Other course services.

Learners should download any available certificate before access expires.

Acanex may extend access where:

• A technical problem caused by Acanex prevented access for a significant period;
• The course was temporarily unavailable;
• An extension is required by law; or
• Acanex considers an extension fair and appropriate.

An extension is not automatic and must be confirmed by Acanex.

9. Prices and Payments

Acanex controls all course sales and payments made through the platform.

Course prices will be displayed on the course page or during checkout. Before confirming a purchase, learners should review:

• The course description;
• The price;
• The currency;
• The access period;
• The instructor information;
• The curriculum; and
• Any certificate or assessment conditions.

Payments may be accepted through approved methods such as MTN Mobile Money, Orange Money or other providers introduced by Acanex.

A payment is considered successful only after confirmation by Acanex or the relevant payment provider.

Users are responsible for providing accurate payment information and ensuring that they are authorised to use the selected payment method.

Learners must not send payments directly to an instructor unless Acanex has expressly authorised the payment and provided official instructions.

Acanex is not responsible for unauthorised payments made:

• Directly to an instructor;
• To another learner;
• To a fraudulent account;
• Through an unofficial payment channel; or
• Contrary to Acanex’s published instructions.

Acanex may change course prices. A price change will not normally affect a course already purchased, except where required to correct an obvious error or comply with law.

10. Refunds and Overpayments

10.1 No access to a purchased course

A learner may request a refund where:

• Payment was successfully completed;
• The learner was not given access to the purchased course;
• The problem was reported to Acanex; and
• Acanex could not provide or restore access within a reasonable period.

Before issuing a refund, Acanex may attempt to:

• Confirm the payment;
• Correct the learner’s account;
• Restore course access;
• Provide alternative access; or
• Offer reasonable technical support.

A refund may be refused where the access problem was caused by:

• Incorrect information provided by the learner;
• Loss or misuse of login details;
• An unsupported or insecure device;
• The learner’s internet connection;
• Account sharing;
• A violation of these Terms; or
• A temporary problem corrected within a reasonable period.

10.2 Overpayments

If a learner pays more than the displayed or agreed price, Acanex will refund the verified excess amount.

Only the difference between the amount paid and the correct price will normally be refunded. The learner will continue to have access to the purchased course.

10.3 Other refund situations

Acanex may also provide a refund:

• Where required by applicable law;
• Where the course is cancelled without a reasonable alternative;
• Where Acanex cannot provide a material part of the purchased service; or
• Where Acanex considers a refund fair and appropriate.

A change of mind, failure to complete a course, failure to attend lessons or dissatisfaction unrelated to a material problem with the course does not automatically qualify for a refund.

These Terms do not remove refund or consumer rights that cannot legally be excluded.

10.4 Requesting a refund

Refund requests must be sent to info@acanex.com and should include:

• The learner’s full name;
• Account email address or username;
• Course purchased;
• Amount and date of payment;
• Transaction reference;
• Reason for the request; and
• Relevant proof of payment.

Acanex may request additional information to verify the payment and identity of the requester.

Approved refunds will normally be returned through the original payment method where possible. Processing times may depend on the payment provider.

False, altered or misleading payment evidence may result in rejection of the request, account suspension and other lawful action.

11. Instructor Earnings

Acanex controls course sales and the collection of payments through the platform.

Acanex determines what instructors earn. The applicable commission, fixed payment or revenue-sharing arrangement will be communicated to the instructor before or during publication of the course.

Instructor earnings may take into account:

• The course price;
• Discounts and promotions;
• Refunds;
• Payment reversals;
• Payment-provider charges;
• Applicable taxes or deductions;
• The agreed commission or revenue share; and
• Other agreed conditions.

Instructors may not:

• Independently collect payments from Acanex learners;
• Redirect learners to unauthorised payment channels;
• Avoid Acanex’s payment system;
• Misrepresent the price of a course; or
• Promise a refund or discount without Acanex’s authorisation.

Acanex may temporarily withhold or adjust instructor payments where reasonably necessary because of:

• Refunds or overpayments;
• Fraud or suspicious transactions;
• Copyright complaints;
• Incorrect payment information;
• Course or account violations;
• Unresolved learner disputes; or
• A legal or regulatory requirement.

Payment schedules and other detailed arrangements may be set out in a separate Instructor Agreement.

12. Certificates and Academic Results

A certificate may only be issued when a learner satisfies the requirements stated for the course.

Requirements may include:

• Completing required lessons;
• Submitting assignments;
• Passing quizzes or examinations;
• Meeting attendance requirements;
• Paying required fees; and
• Complying with academic-integrity rules.

Unless expressly stated otherwise, an Acanex certificate confirms completion of an Acanex course. It does not automatically constitute:

• A government qualification;
• A university degree;
• A professional licence;
• Guaranteed admission;
• Guaranteed employment; or
• Recognition by every school, employer or institution.

Users are responsible for checking whether a certificate is accepted for their intended purpose.

Acanex may withhold, correct or revoke a certificate obtained through:

• Cheating;
• Impersonation;
• Account sharing;
• Fraud;
• False information;
• Unauthorised assistance; or
• Technical or administrative error.

13. Acceptable Use

Users must not:

• Break applicable laws;
• Harass, threaten or abuse another person;
• Discriminate against others;
• Upload viruses or malicious software;
• Attempt to hack or disrupt the platform;
• Attempt to gain unauthorised access;
• Collect another user’s information without permission;
• Send spam or unauthorised advertising;
• Publish unlawful or defamatory material;
• Impersonate another person;
• Create fraudulent accounts;
• Manipulate payments or refund procedures;
• Circumvent course-access restrictions;
• Resell or redistribute course access;
• Use automated systems to copy platform content; or
• Use Acanex in a way that harms learners, instructors or the platform.

Acanex may investigate suspected misuse and preserve relevant records.

14. Academic Integrity

Learners must complete their own work unless collaboration is expressly permitted.

Prohibited conduct includes:

• Cheating;
• Plagiarism;
• Copying answers;
• Sharing examination questions without permission;
• Asking another person to complete an assessment;
• Completing an assessment for another learner;
• Using unauthorised materials;
• Altering results or certificates;
• Impersonating another learner; and
• Using artificial intelligence or other tools contrary to course instructions.

Acanex may investigate suspected academic misconduct and may:

• Issue a warning;
• Require an assessment to be repeated;
• Reduce or cancel a result;
• Withhold or revoke a certificate;
• Suspend course access; or
• Terminate the account.

The action taken will depend on the seriousness of the conduct and available evidence.

15. Intellectual Property

Unless otherwise stated, the platform and its contents belong to Acanex, its instructors or authorised licensors.

Protected content may include:

• Videos;
• Audio recordings;
• Course notes;
• Presentations;
• Questions and quizzes;
• Assignments;
• Examinations;
• Software;
• Website designs;
• Graphics;
• Photographs;
• Logos;
• Trademarks; and
• Course names.

Purchasing a course gives the learner a limited, personal, non-exclusive and non-transferable right to access the course for private educational use during the stated access period.

It does not transfer ownership of the course materials.

Without prior written permission, users may not:

• Copy or reproduce course materials;
• Record lessons;
• Download materials where downloading is not enabled;
• Share login details;
• Redistribute course content;
• Upload content to another platform;
• Sell or commercially exploit materials;
• Remove copyright notices; or
• Create unauthorised adaptations.

Reasonable personal notes may be created for private study.

“Acanex,” “Academic Nexus,” associated logos and branding may not be used without permission.

16. User-Submitted Content

Users may submit assignments, comments, reviews, questions, photographs and other content.

Users retain ownership of content they lawfully create. By submitting content, they give Acanex a limited permission to store, process, display and use it as necessary to:

• Operate the platform;
• Deliver the course;
• Assess work;
• Provide feedback;
• Maintain educational records;
• Moderate the platform; and
• Comply with legal obligations.

Public reviews, comments and instructor profiles may remain visible until removed by the user or Acanex, subject to platform features and lawful retention needs.

Users must have the rights and permissions necessary for all content they submit.

Acanex may remove content that:

• Infringes intellectual-property rights;
• Contains another person’s information without permission;
• Is unlawful, abusive or misleading;
• Contains malware;
• Violates academic-integrity rules; or
• Breaches these Terms.

17. Reviews and Community Features

Acanex welcomes honest, relevant and respectful reviews.

Reviews must reflect the user’s genuine experience and must not contain:

• False statements presented as fact;
• Personal attacks;
• Threats or harassment;
• Private information;
• Spam or advertising;
• Payment credentials;
• Discriminatory material; or
• Content unrelated to the course.

Acanex may moderate or remove content that violates these rules. Acanex will not remove a review merely because it is critical if it is lawful, relevant and submitted in good faith.

Instructors must not pressure learners to provide misleading positive reviews.

18. Third-Party Services

Acanex may use or link to services provided by third parties, including:

• Payment providers;
• Video-hosting platforms;
• Online-class services;
• Email providers;
• Hosting providers;
• Analytics services; and
• External educational resources.

Third-party services may have their own terms, privacy policies and technical requirements.

Acanex does not control and is not responsible for independent third-party services. This does not exclude responsibility that applicable law places directly on Acanex.

19. Platform Availability

Acanex aims to keep the platform secure and available but does not guarantee uninterrupted or error-free access.

Access may be interrupted because of:

• Planned maintenance;
• Software updates;
• Security measures;
• Internet or electricity failures;
• Hosting-provider problems;
• Payment-provider problems;
• Cyberattacks;
• Natural events;
• Government actions; or
• Other circumstances outside Acanex’s reasonable control.

Where reasonably possible, Acanex will attempt to restore access and communicate significant interruptions.

A temporary interruption does not automatically create a right to a refund. Refund eligibility will be assessed under Section 10 and applicable law.

20. Account Suspension and Termination

Acanex may warn, restrict, suspend or terminate an account where it reasonably believes that the user:

• Violated these Terms;
• Provided false information;
• Shared or sold an account;
• Cheated or committed plagiarism;
• Engaged in fraud;
• Harassed another person;
• Infringed intellectual-property rights;
• Created a security risk;
• Failed to make a required payment;
• Misused the refund process; or
• Used the platform unlawfully.

Acanex may act immediately where necessary to protect users, evidence, the platform or legal rights.

Where appropriate, Acanex may notify the user of the reason and provide an opportunity to respond.

Termination may result in loss of access to courses and platform features. It does not remove payment obligations, intellectual-property restrictions or other provisions intended to continue after termination.

A user may request account closure by contacting info@acanex.com. Some records may still be retained where required for legal, accounting, educational or security purposes.

21. Privacy and Personal Information

Acanex handles personal information according to its Privacy Policy and applicable law.

The Privacy Policy explains:

• What information Acanex collects;
• Why it is used;
• Who may receive it;
• How it is protected;
• How long it may be retained; and
• How users can make privacy requests.

The Privacy Policy is available on the Acanex website.

22. Disclaimers

Acanex works to provide useful educational services but does not guarantee that:

• Every course will meet every learner’s individual needs;
• A learner will achieve a particular grade;
• A learner will pass an official examination;
• A certificate will be accepted by every institution;
• A course will lead to employment or admission;
• Every piece of content will always be completely error-free; or
• The platform will always be available without interruption.

Learning outcomes depend on several factors, including participation, effort, preparation and circumstances outside Acanex’s control.

Acanex will take reasonable steps to correct material errors brought to its attention.

Nothing in these Terms excludes warranties, duties or consumer rights that cannot legally be excluded.

23. Limitation of Responsibility

To the extent permitted by applicable law, Acanex will not be responsible for losses caused solely by:

• A user’s failure to follow instructions;
• Incorrect information provided by a user;
• Unauthorised account sharing;
• Loss of a password;
• A user’s device or internet connection;
• An unauthorised payment channel;
• Independent third-party services;
• Unlawful user content; or
• Events outside Acanex’s reasonable control.

Acanex does not exclude responsibility for its own fraud, intentional misconduct or any liability that cannot legally be limited.

Users are responsible for maintaining appropriate devices, internet access and software needed to use online courses unless Acanex expressly agrees otherwise.

24. Complaints and Disputes

Users are encouraged to contact Acanex first so that a concern can be investigated and, where possible, resolved.

Complaints should be sent to info@acanex.com and should include:

• The complainant’s full name;
• Account email or username;
• A clear explanation of the issue;
• Relevant dates;
• Supporting evidence; and
• The requested outcome.

Acanex may verify the complainant’s identity and review account records, system logs, course activity, communications and payment information.

A complaint or accusation does not automatically establish wrongdoing.

False statements, impersonation, forged evidence, threats, harassment or deliberate misuse of the complaint process may result in account restrictions or other lawful action.

Nothing in these Terms removes a legal right or remedy that cannot be excluded.

25. Changes to These Terms

Acanex may update these Terms to reflect:

• New services;
• New payment methods;
• Changes to courses;
• Changes to platform features;
• Security requirements;
• Changes in business operations; or
• Changes in applicable law.

Updated Terms will be published on the website with a revised “Last updated” date.

Important changes may also be communicated through the platform or by email.

Where a change materially affects an existing paid course, Acanex will take reasonable steps to protect the learner’s existing rights.

26. General Provisions

26.1 Entire agreement

These Terms, the Privacy Policy, applicable course information and any additional agreement accepted by the user form the agreement between Acanex and the user.

Instructor relationships may also be governed by a separate Instructor Agreement.

26.2 Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

26.3 No waiver

If Acanex does not immediately enforce a provision, this does not mean that Acanex has permanently waived the right to enforce it.

26.4 Assignment

Users may not transfer their accounts, course access or rights under these Terms without written permission from Acanex.

Acanex may transfer its rights and obligations as part of a lawful business restructuring, merger or transfer, provided users’ applicable rights are respected.

26.5 Electronic communications

Users agree that Acanex may send account, course, payment, security and legal notices electronically through email or the platform.

Users are responsible for maintaining an active and accurate email address.

27. Governing Law

These Terms are governed principally by the laws of the Republic of Cameroon.

The parties should first attempt to resolve disputes in good faith by contacting Acanex.

Where a dispute cannot be resolved informally, it may be submitted to a competent court in Cameroon, subject to any consumer right or mandatory legal rule that requires another procedure or jurisdiction.
